1. Acceptance of Terms
By accessing or using the Echo platform ("hellofrom.today"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
2. User Content & Ownership
You retain all ownership rights to the audio recordings, transcripts, and personal stories ("User Content") you upload to the platform. By uploading, you grant Echo a limited, non-exclusive license to process, store, and transmit this data solely for the purpose of providing the Service.
- Consent: You represent and warrant that you have obtained the explicit consent of any individuals whose voice or likeness is recorded and processed by the Service.
- Prohibited Content: You may not upload content that is illegal, defamatory, or infringes on the intellectual property rights of others.
3. AI Voice Generation (ElevenLabs)
Our platform utilizes ElevenLabs for voice cloning and Text-to-Speech (TTS) generation.
- Strict Consent Requirement: You may only use the voice cloning feature to replicate the voice of yourself, or a family member who has explicitly granted you permission (or for whom you are the legal executor/guardian).
- Deepfake Prohibition: Any attempt to use the platform to generate deceptive audio, impersonate public figures, or commit fraud will result in immediate account termination and potential legal action.
4. Blockchain Immutability (Arweave & Solana)
The core feature of Echo is the "Sealing" of memories to the blockchain (Arweave for storage, Solana for NFT ownership).
- Permanence: Once a memory is Sealed, it is permanently written to a decentralized ledger. Echo cannot alter, edit, or delete this data.
- Loss of Keys: If you choose to self-custody your encryption keys or NFT assets, Echo cannot recover them if lost. If you lose your keys, your Sealed memories may become permanently inaccessible.
5. Service Availability & Subscriptions
Echo provides both subscription-based services (billed monthly/annually via Stripe) and one-time "Forever" purchases.
- Refunds: Subscriptions can be canceled at any time. We offer a 14-day money-back guarantee on the initial purchase of the "Forever" tier, provided no memories have been Sealed to the blockchain.
- Uptime: While we strive for 99.9% uptime for our centralized services (Supabase, Next.js frontend), we are not responsible for downtime caused by third-party AI providers (Google Cloud, ElevenLabs) or blockchain network congestion (Solana).
6. Limitation of Liability
To the maximum extent permitted by law, Echo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or emotional distress resulting from the use or inability to use the Service.
